Welcome to LandLyze! These Terms of Service ("Terms") govern your access to and use of the LandLyze website, software, and services (collectively, the "Service") provided by LandLyze ("we," "us," or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

2. Service Description

LandLyze is an AI-powered Software as a Service (SaaS) application designed to analyze and optimize website landing pages. Users can input a URL, and the Service performs analysis covering performance metrics (e.g., PageSpeed scores), SEO, accessibility, UI/UX design, and provides AI-driven insights, actionable recommendations, and an interactive chat feature for further clarification.

3. Account Registration

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Subscription Plans and Payment

LandLyze offers various subscription plans, including a "Free" tier and paid tiers such as "Mini" and "Pro". Each plan has specific usage limits, such as the number of landing page analyses and AI chat prompts allowed per month.

  • Free Tier: Limited access as described on our pricing page.
  • Paid Subscriptions (Mini, Pro): Grant access to higher usage limits and potentially additional features as described on our pricing page. Subscription fees are billed on a recurring basis (e.g., monthly or annually) as selected by you.
  • Payments: You agree to pay all applicable fees for your chosen subscription plan. Payments are processed through a third-party payment processor (e.g., Stripe). You authorize us and our payment processor to charge your payment method for the subscription fees.
  • Automatic Renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled by you before the renewal date through your account settings or by contacting support.
  • Fee Changes: We reserve the right to change subscription fees. We will provide reasonable notice of any fee changes, typically at least 30 days, before they take effect.

5. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for:

  • Ensuring you have the necessary rights to analyze the URLs you submit to the Service.
  • Maintaining the confidentiality of your account information.
  • Complying with all applicable laws and regulations.
  • Not using the Service to infringe on the intellectual property rights of others.
  • Not attempting to disrupt or interfere with the security or integrity of the Service.

6. Intellectual Property

  • Our Service: We own all rights, title, and interest in and to the Service, including all related software, technology, and documentation, and all intellectual property rights therein. You are granted a limited, non-exclusive, non-transferable license to access and use the Service according to your subscription plan.
  • Your Data: You retain ownership of the URLs you submit and any underlying content on those pages.
  • AI Output: The analysis, recommendations, and chat responses generated by the AI ("AI Output") are provided for your information and use. While you can use the insights and implement the recommendations, the AI Output itself is generated by complex models. We grant you a license to use the AI Output in connection with optimizing the specific landing page analyzed, but LandLyze retains underlying rights to the models and technology generating the output. You use the AI Output at your own risk.
  • Feedback: If you provide us with feedback or suggestions regarding the Service, you grant us the right to use such feedback for any purpose without obligation to you.

7. Termination

  • By You: You can terminate your account and subscription at any time through your account settings or by contacting us. Termination will be effective at the end of your current billing cycle for paid plans. No refunds are provided for partial billing periods, except as outlined in our Refund Policy.
  • By Us: We may suspend or terminate your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WHILE WE STRIVE TO PROVIDE ACCURATE AND HELPFUL ANALYSIS, WE DO NOT WARRANT THAT THE SERVICE OR THE AI OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR UNINTERRUPTED. THE AI OUTPUT IS FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE SOLELY RELIED UPON FOR MAKING BUSINESS DECISIONS. YOU ARE SOLELY RESPONSIBLE FOR IMPLEMENTING ANY RECOMMENDATIONS AND FOR THE RESULTS THEREOF.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LANDLYZE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI OUTPUT; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL LANDLYZE'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS PAID BY YOU TO LANDLYZE FOR THE PAST THREE MONTHS OF THE SERVICE IN QUESTION.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website or through other communication channels. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
